IMPORTANT NOTICE: THESE TERMS CONTAIN A MANDATORY ARBITRATION PROVISION AND WAIVER OF CLASS ACTION RIGHTS. PLEASE READ SECTION 14 CAREFULLY, AS IT AFFECTS YOUR LEGAL RIGHTS AND REMEDIES.
1. Acceptance of Terms
By accessing or using the website located at driversconfidence.com (the "Platform"), owned and operated by Drivers Confidence ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must strictly stop using the Platform immediately
We reserve the right to modify these Terms at any time. Your continued use of the Platform constitutes your acceptance of any changes.
2. Nature of Service: NOT Legal Advice
Drivers Confidence is NOT a law firm, and we are NOT attorneys.
- Self-Help Service: We provide an automated software platform that allows you to generate legal forms (specifically the Request for Trial by Written Declaration) based on your own direction. We act as a "legal document assistant" or self-help service.
- No Attorney-Client Relationship: Your use of the Platform, and any communication with our support team, does not create an attorney-client relationship. All information provided on the Platform is for general informational purposes only and does not constitute legal advice.
- User Responsibility: You are representing yourself in this legal matter ("Pro Per"). You are solely responsible for the accuracy of the information you provide, meeting all court deadlines, and making all final decisions regarding your legal defense.
3. Eligibility
To use our services, you must:
- Be at least 18 years old.
- Possess a valid driver's license.
- Have a traffic citation issued within the State of California that is eligible for Trial by Written Declaration under California Vehicle Code (CVC) § 40902.
We reserve the right to refuse service to anyone for any reason at any time.
4. Scope of Services
Our service is limited to the automated generation of the following California Judicial Council forms based on the data you input:
- Form TR-205: Request for Trial by Written Declaration.
- Form MC-031: Attached Declaration (if applicable).
We DO NOT:
- File documents with the court on your behalf.
- Post bail on your behalf.
- Represent you in court.
- Guarantee any specific outcome.
5. User Responsibilities and Acknowledgments
By using this Platform, you explicitly acknowledge and agree that:
- Filing Responsibility: You are solely responsible for printing, signing, and mailing your documents to the correct court address via Certified Mail.
- Bail Requirement: You understand that California law requires you to post the full amount of bail (the fine) when submitting your Trial by Written Declaration. Drivers Confidence does not pay your bail.
- Deadlines: You are solely responsible for knowing and meeting the due date listed on your citation or courtesy notice. We are not responsible for late filings or rejected documents due to missed deadlines.
- Accuracy: You certify that all information you provide to the Platform (including ticket details, personal information, and narrative facts) is true and accurate. We do not verify the truthfulness of your statements.
6. Payments and Refunds
- Fees: We charge a one-time service fee to generate your defense package. You agree to pay the fees displayed at the time of purchase.
- No Contingency: Our fee is for the preparation of documents, not the outcome of your case. The fee is due regardless of whether the court dismisses your ticket or finds you guilty.
- Refund Policy: Because our product is a digital good (PDF) delivered immediately upon payment, all sales are final. We may, at our sole discretion, offer a refund if there was a technical error on our part that prevented the generation of your documents. We do not offer refunds based on the outcome of your court case.
7. No Guarantee of Results
We make NO guarantees, warranties, or representations regarding the outcome of your traffic ticket case.
Traffic court outcomes depend on numerous factors outside our control, including the judge's discretion, the officer's testimony, and the specific evidence available. The "Statement of Facts" generated by our Platform is a defense strategy based on common legal arguments, but its success is not guaranteed.
8. Intellectual Property
The Platform, including its source code, "agentic" interview logic, text, graphics, and user interface, is the exclusive property of Drivers Confidence and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Platform solely for your personal, non-commercial use to fight your own traffic ticket.
9. Disclaimer of Warranties
THE PLATFORM AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, DRIVERS CONFIDENCE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE DOCUMENTS GENERATED WILL BE ACCEPTED BY THE COURT, THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DRIVERS CONFIDENCE, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SERVICE.
YOU SPECIFICALLY ACKNOWLEDGE THAT WE ARE NOT LIABLE FOR THE OUTCOME OF YOUR LEGAL CASE, ANY FINES OR PENALTIES IMPOSED BY THE COURT, OR ANY POINTS ADDED TO YOUR DRIVING RECORD.
11. Indemnification
You agree to defend, indemnify, and hold harmless Drivers Confidence and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:
- Your use of the Platform.
- Your violation of these Terms.
- Your violation of any third-party right.
- Any claim that your use of the service caused damage to a third party.
- Any outcome of your traffic court case.
12. Electronic Communications
You consent to receive communications from us electronically, including via email and dashboard notifications. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
13. Third-Party Links and Services
Our Platform may contain links to third-party websites or services (e.g., Stripe for payments). We are not responsible for the content, privacy policies, or practices of any third-party sites.
14. Dispute Resolution: Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS.
14.1 Mandatory Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, or the Service (collectively, "Disputes") shall be resolved solely by binding arbitration in accordance with the rules of the American Arbitration Association ("AAA") rather than in court. The arbitration shall be conducted in Los Angeles County, California. The arbitrator's decision shall be final and binding.
14.2 Class Action Waiver
YOU AND DRIVERS CONFIDENCE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Drivers Confidence agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
14.3 Jury Trial Waiver
You and Drivers Confidence hereby waive any constitutional and statutory rights to sue in court and have a trial in front of a judge or a jury.
14.4 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect
